BOOKING CONDITIONS

Welcome to www. emaworldtravel.com.

The website contains information on our different services to which you may request quotations from our travel advisors. This website is provided solely to assist customers in gathering travel information and making a quote request. Please read them carefully as they are legally binding.

Definitions

“Ema World Travel Ltd” or “Ema Voyage”, “us”, “we”, or “our”

means the company “Ema World Travel Ltd” whose registered office is at “Avenue des Barracudas, Morc. De Chazal, Albion, Mauritius

“You”

means the customer visiting our website, booking a reservation through us.

“Ema World Travel website”

means the website www.emaworldtravel.com

 

“Trip”

means the different travel products and services that can be ordered, acquired, bought, paid, rented, reserved, purchased and/or combined, or consumed by you from the Trip Provider.

“Trip Provider”

means the provider of airlines air tickets, accommodations, car rental, transfers, cruises, tours and any other product or service required or related to a trip.

“Trip Service”

means the purchase, order or reservations service as offered or enable by Ema World Travel Ltd in respect to various products and services as from time to time made available or advertised on the website.

“Trip reservation”

means the booking, reservation, order, purchase of a trip reservation.

 

“Package”

means a fixed price of the different services listed on your travel itinerary. No breakdown applies.

1. Contract

Our travel package is tailored to your requirements and so bookings are subject to availability. For each proposed package it is clearly stated what is included in the travel itinerary. Unless otherwise stated in our travel itinerary the price does not include airline ancillaries (e.g., exit seat, upgrade), excess baggage, eco taxes, electricity taxes or charges, room service or supplement, bar services, beverages, telephone communications, paid parking, paid Wi-Fi, tours, or excursions, sport activities, tips, and personal expenses.

Once you have confirmed to us that you are happy with the proposal, we will proceed to take payment and issue you with a booking confirmation.

Please immediately check for all aspects of your booking. Passenger names, email address, mailing address, mobile number that you will be using during your trip, date of birth, airfare, arrival/departure airports, accommodations, and organized activities on your booking receipt. Please notify us immediately if any omissions and/or corrections are needed regarding the booking details.You voluntarily assume full & sole responsibility for all risks and/or costs involved with failure to report such errors and/or omissions.

Price and Payment
Before confirmation, we reserve the right to alter the prices of any trips set out in our written proposal to you at any time before your booking is confirmed. You will be advised of the current price before your booking is confirmed.

The price of your package is inclusive of taxes and where applicable, all additional fees and charges and other cost. Where any costs cannot be reasonably calculated by us in advance of the conclusion of your contract, we will give you an indication at the time of booking of the type of additional cost which you may still have to bear.

We hold reservations/bookings until “Time Limit” agreed. If payment is not received by us on or before the “Time Limit”, reservations are automatically cancelled. We reserve the right to cancel your tickets prior or during travel in case full amount if not settled with us according to agreed ‘time frame’.
Change/Abuse/Illegal Use of this document leading to additional cost to us must be paid by customers. We reserve the right to prosecute any user who voluntary uses this documents to cause harm in any manner to Ema World Travel Ltd, its employees or a third par
Late payment, wrong bank, debit or credit card details, invalid credit/debit cards, or insufficient funds are for your own risk and account, and you will not be entitled to any refund of any (non-refundable) prepaid amount unless the Trip Provider agrees or allows otherwise under its (pre)payment and cancellation policy.

3. Scope of This agreement

We sell a variety of travel related products from different Trip providers. By using the trip services, you enter a legally binding contractual relationship with the Trip Providers with which you make a reservation or purchase a product or service (as applicable). From the point at which you make a trip reservation, we act solely as an intermediary between you and the trip provider. We are not a co-vendor of such products and services.

By making a Trip Reservation with a Trip Provider, you accept and agree to the relevant cancellation and no-show policies of the Trip Provider and to any additional terms and conditions of the Trip Provider that apply to your Trip (including the terms and conditions of the Trip Provider made available on the Website and/or that we provide to you during the booking process). The general cancellation rule and no-show policy of each Trip Provider is made available on the Trip Provider Website, during the reservation procedure and in the confirmation email or ticket (if applicable).

Certain special offers, rates or fees are not eligible for cancellation, refund, or change.
If you want to review, adjust, or cancel your Trip Reservation, contact us by email, telephone or meet our Travel Experts. Note that you may be charged for your cancellation in accordance with the Trip Provider’s cancellation, (pre)payment and no-show policy, or not be entitled to any repayment of any (pre)paid amount. It is highly recommended that you read the cancellation, (pre)payment and no-show policy of the accommodation provider carefully prior to making your reservation and remember to make further payments on time as may be required for the relevant reservation.
If you are unable to undertake your Trip due to:

unexpected health or medical events, including (but not limited to) death, pregnancy, broken bones and hospitalisation; or unavoidable and exceptional circumstances that are not within your or our control, such as natural disasters, terrorist attacks, wars, a high level travel warning issued by government or authority in the region of travel;
epidemics/pandemics or collapse of buildings, fires, explosions or accidents, please get in touch with us for information on how we may assist you.
If you have a late or delayed arrival on the check-in date or only arrive the next day, make sure to communicate this with the Trip Provider in a timely way so they know when to expect you to avoid cancellation of your Trip (Reservation) or charge of the no-show fee.

Ema World travel Ltd does not accept any liability or responsibility for the consequences of your delayed arrival or any cancellation or charged no-show fee by the Trip Provider.

4. Passport, Visa, and immigrations requirements

It is your responsibility to consult the relevant embassy and/or consulates for passport, visa, and other immigrations requirements of the countries you are visiting. It will not be our responsibility if you are unable to travel due to not complying with any such requirements.

If you are travelling on a special student/youth/teacher ticket, you are also required to carry valid International Student I.D., and International Youth I.D. or an International Teacher I.D card. It is your responsibility to verify this with our travel advisor who is assisting you.

When requested by you, we charge a non-refundable visa service fee for visa application assistance services.

The visa service fee is non- refundable even if visa is not granted.

Courier fee may be applied when passport must be sent to embassy and/ or consulate, Department of Home of Affairs or any authority which are not based in Mauritius.

We offer no guarantee that your application will be successful.

If a visa application is rejected for whatever reason, we shall not be held responsible for any prejudice suffered by you.

We do guarantee, represent, or warrant that travel to international destinations is advisable or without risk and is not liable for damages or losses that may result from travel to such destinations.

5. Air Transportation

Where possible we will provide you with information on:

check in and boarding times;
baggage allowances and restrictions; and
whether it is possible to book infant/child tickets online.
However you should always check the relevant Air Carrier’s website for complete details for information on:

suitability of passengers for flying (for instance elderly, pregnant or infant passengers)
rules on passengers carrying lithium batteries, dangerous goods and liquids; and/or
Baggage allowances
applications for special meals and/or services before your journey, you should check the relevant Air Carrier’s website for details as different Air Carriers may have different policies or rules. If you wish to order special meals and/or services via us, please contact us by using the details below and we will try to assist.
It is your responsibility to ensure that you allow sufficient time for check-in, passport control and security checks after you arrive at the relevant airport terminal.

Travel conditions:

Please refer to section 1 for aspects regarding your booking.
The carriage service is only provided to the Passenger named on the ticket.
Air Tickets must be used in the sequence set out in your travel itinerary, otherwise the relevant airline may not allow you to check in or board the plane. For instance, if you do not use your outbound Air Ticket, the airline may not allow you to use your return Air Ticket.
Please download the app of the airline you intend to travel during your trip. By doing so you will get all mandatory information and be able to do online check in easily one day prior to your departure and submit all required documents when applicable.
LIMITATION OF LIABILITY: Purchase of Air Tickets

Without limitation, Passenger(s) assume the risk of, and agree that Ema World Travel Ltd is not liable for any damages arising from or related to any act of God or public enemies, arrest, restraints of any government or rulers of people, piracy, war, revolution, extortion, terrorist activity, threatened or actual rebellion, political upheaval, civil unrest, riots, fire, lockouts, explosion, collision, weather conditions, dangers incident to the sea, mechanical or construction failures or difficulties, diseases, local laws, abnormal conditions or developments, closure of airports/seaports/hotels/train stations, carrier or supplier logistical problems, computer problems stranding, food or water poisoning, illness, grounding, perils of the sea, rivers, canals, locks or other waters, perils of navigation of any kind, theft, accident to or from machinery, boilers, or latent defects even though existing at commencement of the trip, desertion or revolt of crew, or lost/damaged/delayed luggage.

 

 

6. Accommodation

The number of stars attributed to the hotel may vary according to the respective local hotel industry association. Where possible we strive to provide you with the accurate information.

Standard hotels check in and check out policies.

While some hotels brands differ slightly and unless otherwise provided, the universal check in time is at 15h00 and universal check out time at 11h00 in the morning on departure day.

Based on availability, hotel may offer early check in or late check out against additional charges which could be 50 to 100% of the applicable price per night.

According to your choice at booking time, you may be on half board or full board basis. Unless otherwise arranged, full board meal start with dinner on check in day and ends up with breakfast on check out day. For half board basis, the meal starts with dinner and ends up with breakfast. If you miss your meal due to late arrival of you flight, no refund applies. Drinks such as tea, coffee and juices are included in breakfast. For other meals, may it be on half board or full board beverages are not included.

Some activities offered may represent some risk particularly for children. Participation in any activities and/or uses of the facilities are at your own risk, and you absolve us from all liability in contract, or delict for any loss from any cause whatsoever (including negligence) arising from such participation and/or uses.

 

Terms and conditions applicable to rental of houses, appartements and villas

 

“Check in” and “check out” time.

Subject to policy, note that the universal check in time is at 15h00 and universal check out time at 11h00 in the morning on departure day.

Cleaning services

Wherever applicable, cleaning services are provided 6 days weekly for two or three hours. Tenant is reminded that cleaning employees have no other obligation such as cooking, shopping or baby sitting amongst others.

Your Responsibilities.

You are responsible for leaving an Accommodation (and related personal property) in the condition it was in when you arrived, (ii) you are responsible for paying all Damage Claim amounts necessary to cover damage that you, your guest(s), or your pet(s) cause to an Accommodation, and (iii) you must act with integrity, treat others with respect and comply with applicable laws at all times.

 

7. Insurance

We highly recommend that you take an adequate multi risk optional insurance (cancellation, assistance, repatriation, luggage) for the entire duration of your journey. In addition to the risks of unforeseen events that may occur before the start of the stay or departure, this insurance covers the main risk that may arise during a trip or stay or during the practice of activities offered in the package/program. Please note that you are responsible for declaring claims to the insurer during the time limits specified by the insurer.

8. Amendment, transfers, and cancellation by you

Any amendment, transfers and cancellation request must be sent by email to welcome@emaworldtravel.com.

 

(a) Amendment

If after our booking confirmation has been issued, you wish to change your travel arrangements, our standard service fee applies in addition to any additional trip provider charges. Please note that all reservation changes are subject to availability and the terms and conditions of the trip purchased.

(b) Transfers

Changes to details are not allowed by many airlines and trip provider. While we will endeavor to make such change, if necessary, please bear in mind that most airline and trip provider treat a name change as a cancellation to which standard conditions and charges would apply.

(c) Cancellation

If you cancel your trip, subject to all applicable terms and conditions, you may be entitled to a partial refund. In addition to the cancellation terms and conditions of your trip provider (s), our standard fees will apply. We need to meet us in person with your booking confirmation and trip itinerary before any applicable refund can be considered.

Refunds will only be paid to you once we received the funds back from the trip provider(s).

Please note that generally flight tickets cannot be refunded if they are partially used. We are not responsible for a Trip Provider’s failure to pay a refund.

 

9. If you have a Complaint

If you have a problem during your trip, please immediately inform the trip provider. Should they be unable to solve the matter, please immediately contact us either through welcome@emaworldtravel.com or on our emergency mobile phone number 24/7 25052528819 (we respectfully request you to be considerate of time zones). If you fail to timely contact us, we will not have the opportunity to investigate your complaint and attempt to rectify any error while you are away, and this may affect any refunds if available.

10. Assistance

We will always provide you appropriate assistance without undue delay if you are in difficulty. This will include providing appropriate information on health services, local authorities, and consular assistance, assisting you to make communications and helping you to find alternative travel arrangements. We may charge you a reasonable fee for such assistance if the difficulty is caused intentionally by you or through your negligence.

11. Special requests

Whilst we will endeavor to comply with any special requests we receive (such as special airline meal or dietary requirements, specific airline seating, special room request) and pass it to the relevant Trip Provider(s). However, we are unable to guarantee compliance with such requests and are not liable for any loss suffered in the event of such requests not being complied with.

12. Data Protection

To enable us to process and fulfil your booking, we will ask you to provide us with personal information including name, address, email address, telephone number, details of group members that are travelling, as we well as any special needs, health, medical, mobility or dietary requirements. Ema World Travel Ltd is the data controller of any personal information that you provide to us under the General Data Protection Regulation 2016/679 and the Data Protection Act 2018 and is registered with the Information Commissioner’s Office.

To ensure that your holiday is appropriate for your specific needs that you have disclosed to us, for example, a medical condition or reduced mobility, we or the Trip Providers of your travel arrangements may require further details. We will ask for your explicit consent to collect and share this information as necessary with the Trip Providers of your travel arrangements to fulfil your booking.

We may pass personal information that you provide to us (including health and mobility information as explained above) on to relevant Trip Providers of your travel arrangements such as airlines, hotels, transport companies and local tour operators and destination management companies as necessary to fulfil your contract.

To process and fulfil your contract, your personal information may also be provided to public authorities such as customs and immigration, security and/or credit checking companies, credit and debit card companies and government and enforcement agencies if required by them for us to fulfil your booking, or as required by law. Your personal information may be shared with the police or other law enforcement or crime prevention agencies for security purposes.

If you travel outside the European Economic Area (EEA), your personal information may have to be sent to Trip Providers and other third parties outside the EEA where controls on data protection may not be as strong as the legal requirements in this country. This may also apply to any sensitive information that you give to us such as details of any health issues, disabilities, or reduced mobility. If we cannot pass this information to the relevant Trip Providers, whether in the EEA or not, we cannot properly complete your booking. We will ensure that adequate safeguards are in place before transferring any of your personal information outside of the EEA. Please see our Privacy Policy for further details.

If you are travelling to the US, the US Customs and Border Protection require us to provide them with your personal information for the purposes of preventing and combating terrorism and other transnational serious crimes. International travelers who are seeking to travel to the US under the Visa Waiver Program (VWP) are now subject to enhanced security requirements and will be required to complete an ESTA (Electronic System for Travel Authorization) 72 hours before departure and pay an administrative fee.
